This fear stops more people from entering treatment than almost any other. The answer: federal law protects you, and the reality is far less scary than the fear.

FMLA: Your job is protected

The Family and Medical Leave Act provides up to 12 weeks of unpaid, job-protected leave for medical conditions including addiction treatment. Your employer must hold your position (or an equivalent one). You need: 12+ months at the employer, 1,250+ hours worked in the past year, and employer has 50+ employees. Your employer learns you are taking medical leave but does NOT learn the diagnosis. Addiction treatment is classified as a serious health condition under FMLA.

ADA: You cannot be fired for recovery

The Americans with Disabilities Act protects people in recovery from addiction from employment discrimination. Key protections: you cannot be fired for being in recovery or having a history of addiction. You cannot be denied employment for past addiction if you are currently in recovery. Active use is NOT protected. These protections apply to employers with 15+ employees.

What your employer actually learns

Under FMLA: your employer knows you are taking medical leave. They do NOT know why. Your diagnosis is protected health information. Under insurance: your employer does NOT see individual claims. They receive aggregate data, not your specific treatment. The HR person processing your leave is bound by confidentiality. In practice: most people return from leave and their colleagues assume a medical procedure, family issue, or personal matter. You decide what to disclose.
